Requirements for Notarization

Documents that can be notarized

Legacy & Legal: Living trusts, Adoption records, Medical directives, Estate documents, Legal guardianship forms, Power of attorney, Litigation papers. Commercial: Corporate filings, Business agreements, Supplier contracts, Rental leases, Staffing contracts, Development and financing paperwork.

Documents that cannot be notarized

A Notary Public cannot legally certify duplicates of vital records or public documents, such as certificates for birth, marriage, or death, as these are handled by government registrars.

Every signer must be present, alert, and capable of understanding the document they are executing. The Notary Public is required to witness the signing in real-time; papers must not be signed beforehand. Participants must prove their identity with current, valid government-issued ID. Acceptable IDs include: A valid state driver’s license or ID card, a U.S. or foreign passport, a federal military ID, or a tribal ID card. Additionally, government-issued IDs for employees of state or local municipalities that include a photo, signature, and physical traits are permitted for verification.

State Logs: Oregon law mandates that all Notaries keep a formal activity journal. Your private data remains confidential unless required by a formal legal request or official court subpoena.
